Terms and Conditions - Landscapers Bow

Welcome to our Terms and Conditions page for Landscapers Bow. This document explains the rules, responsibilities, and expectations that apply when you use our landscaping services. By requesting, booking, or receiving any service from us, you agree to these terms. We encourage every client to read this information carefully so that both parties understand the scope of work, payment expectations, service standards, and other important conditions.

1. Introduction

These Terms and Conditions are designed to create clarity and fairness in every project we undertake. Landscaping work often involves planning, site preparation, materials, labor, timing, and site access. Because each project can differ, it is important to define the terms under which work is carried out. These conditions apply to all landscaping services provided under the name Landscapers Bow, including garden maintenance, soft landscaping, hard landscaping, turfing, planting, fencing, paving, and related outdoor services.

By using our services, you confirm that you have the authority to request the work and accept responsibility for ensuring access to the property and any relevant permissions. It is your responsibility to provide accurate information about the site, the project, and any restrictions that may affect the work.

2. Scope of Services

We aim to provide professional and reliable landscaping services tailored to each client’s requirements. The exact scope of work will depend on the agreed project, the condition of the site, and any written or verbal quotation provided before work begins. Services may include the following:

  • Garden design and layout preparation
  • Lawn installation and turf laying
  • Garden maintenance and seasonal care
  • Planting trees, shrubs, and flowers
  • Paving, patios, and paths
  • Fencing and garden boundary improvements
  • Soil improvement and ground leveling
  • Removal of waste generated during the agreed works

Any work that falls outside the agreed scope may require a revised quotation or additional agreement before it is started. We reserve the right to refuse work that is unsafe, unlawful, or beyond the agreed project details.

3. Quotations and Estimates

All quotations are based on the information available at the time of assessment. Estimates may be subject to change if hidden issues, site conditions, or additional client requests are discovered during the job. For example, underground obstructions, poor soil conditions, drainage problems, or unexpected structural concerns may affect the price or timeline.

Written quotations are valid for a limited period and may be withdrawn or adjusted if the work is delayed beyond that period. If a quote is accepted, that acceptance confirms agreement to the price, scope, and any conditions listed alongside it. If the project changes in any way, a revised estimate may be issued for approval before further work is carried out.

4. Booking and Scheduling

Once a service is booked, we allocate time, equipment, and labor based on the agreed schedule. Dates provided are planned in good faith, but they are not always guaranteed due to weather conditions, supply delays, staff availability, or unexpected site issues. Landscaping work is often weather-dependent, and some tasks cannot be completed safely in heavy rain, frost, or extreme conditions.

We will try to keep clients informed of any scheduling changes. However, we are not liable for losses caused by delays beyond our reasonable control. Where necessary, projects may be postponed to a safer or more suitable date. Flexible scheduling often helps ensure the best quality outcome for outdoor work.

5. Client Responsibilities

To help ensure the smooth completion of a project, clients are expected to cooperate with reasonable requests and prepare the site where needed. Responsibilities may include:

  • Providing safe and reasonable access to the property
  • Removing personal belongings from work areas
  • Informing us of hazards, buried services, or access restrictions
  • Securing pets and children away from the work area
  • Confirming boundaries, planning permissions, or ownership matters where relevant

If delays or extra costs arise because access is restricted or the site has not been prepared as agreed, additional charges may apply. We are not responsible for damage caused by items left in the working area if reasonable notice was given to clear them beforehand.

6. Materials and Supplies

Materials used in landscaping work may include plants, timber, turf, topsoil, gravel, paving, sand, aggregate, and other related products. Unless otherwise agreed, material choices are based on availability, suitability, and project requirements. Natural materials can vary in color, texture, size, and finish. This variation is normal and should not be considered a defect.

If a client requests specific materials, those preferences should be made clear before the work begins. Any special order materials may require advance payment or deposits. We are not liable for delays caused by suppliers, shortages, or material backorders. When selecting natural products, slight variation should be expected as part of the product’s character.

7. Payments and Invoicing

Payment terms will be explained before work begins and may vary depending on the size and type of job. Smaller projects may require payment on completion, while larger projects may require deposits, staged payments, or progress invoices. Any payment structure will be agreed in advance wherever possible.

Invoices should be paid by the due date stated on the invoice or payment request. Late payment may result in suspended work, recovery action, or additional charges where permitted by law. If a deposit has been taken to secure a booking or purchase materials, this may be non-refundable unless otherwise stated. Failure to make payment on time may affect future bookings or continuation of services.

8. Deposits and Cancellations

Deposits may be required to confirm larger landscaping projects or to reserve a schedule slot. Deposits often help cover planning time, admin costs, or upfront material purchases. If a client cancels after a deposit has been used to secure resources or begin procurement, part or all of the deposit may be retained to cover losses already incurred.

If you need to cancel or rearrange a booking, please provide as much notice as possible. Cancellations made at short notice may be subject to a charge, especially if the team or materials have already been allocated. We reserve the right to cancel or reschedule work if safety concerns, non-payment, or unforeseen issues make the project unsuitable to continue.

9. Changes to the Project

Project changes may happen during landscaping work due to client requests, site conditions, or practical limitations. If you ask for changes after the work has started, we may need to adjust the cost and completion time. Any variation that increases labor, equipment use, or material requirements may be charged separately.

We recommend discussing changes as early as possible to avoid confusion and delays. Where a variation materially changes the original agreement, we may provide an updated quotation or written confirmation before proceeding. This helps protect both the client and the service provider from misunderstandings.

10. Site Conditions and Hidden Issues

Outdoor projects often involve variables that cannot be fully identified in advance. Ground conditions, drainage systems, buried debris, tree roots, unstable surfaces, and hidden structures may not be visible before work starts. If such issues are discovered, the project may need to stop temporarily while a solution is considered.

Additional work required to deal with hidden issues may be charged separately. We are not responsible for pre-existing defects, structural problems, or underground services that were not disclosed or reasonably visible before the work began. All landscaping work is carried out with practical care, but hidden site conditions can affect both cost and completion time.

11. Waste Removal and Clean-Up

Unless otherwise agreed, we will aim to leave the work area tidy and remove waste directly related to the agreed job. However, the exact level of clean-up may depend on the scope of the service, access to waste facilities, and the volume of materials involved. Some projects may require separate waste removal charges.

We are not obligated to remove items that were not created by the work or were not included in the service agreement. If a client wants a higher level of site clearance or disposal, this should be discussed beforehand. Any waste generated remains the property of the client unless disposal has been included in the service arrangement.

12. Liability and Limitations

We take reasonable care in delivering landscaping services, but we are not liable for damage caused by pre-existing defects, hidden site conditions, client negligence, severe weather, or misuse after completion. Our liability is limited to the value of the service provided, except where otherwise required by law.

We are not responsible for indirect losses such as loss of use, loss of income, or inconvenience caused by delays, weather, supplier issues, or project changes. Clients are encouraged to inspect the work upon completion and raise any concerns promptly. Prompt communication helps resolve concerns more efficiently and fairly.

13. Guarantees and Workmanship

Where a guarantee is offered, the terms of that guarantee will be explained clearly and will apply only to the specific work covered. Natural products such as plants, turf, and timber may be affected by seasonal change, weather, and maintenance practices, so guarantees may not apply in every situation. Proper aftercare is important for the long-term performance of landscaping features.

Any issues resulting from misuse, neglect, poor maintenance, or interference by third parties are not covered. Maintenance recommendations may be provided to support the durability and appearance of the completed work, but responsibility for ongoing care may rest with the property owner or occupier.

14. Access, Health, and Safety

Health and safety are important on every site. We may pause work if a site becomes unsafe or if access is restricted in a way that creates risk. Clients should make us aware of any known hazards, including unstable ground, electrical cables, water pipes, pets, aggressive animals, or other risks that could affect the team or the property.

If work must stop because the area is unsafe or because suitable access has not been provided, the client may be responsible for additional charges related to lost time or rescheduling. Safe working conditions support both quality and efficiency.

15. Permits, Permissions, and Compliance

Some landscaping work may require planning permission, permission from a landlord, or approval from a managing agent, especially if the project affects boundaries, drainage, access, or shared land. It is the client’s responsibility to obtain any required approvals unless we have specifically agreed in writing to manage that process.

All work will be carried out with reasonable regard for applicable laws, regulations, and industry practices. If a project appears to breach local rules or property obligations, we may refuse to proceed until the matter is clarified. This protects the integrity of the work and reduces risk for everyone involved.

16. Complaints and Disputes

If you are unhappy with any aspect of the service, please raise the issue as soon as possible so it can be reviewed. We prefer to resolve concerns through direct communication and practical solutions. In many cases, a concern can be addressed by inspection, correction, or explanation.

If a dispute cannot be resolved quickly, both parties should act reasonably and allow time for investigation. Evidence such as photographs, written notes, or project details may be useful when assessing a complaint. We aim to handle disagreements fairly, professionally, and in good faith.

17. Intellectual Property and Project Material

Any designs, plans, concepts, or written project materials supplied by us remain our property unless otherwise agreed. They may not be copied, sold, or reused without permission. This helps protect original design work and ensures that creative materials are used appropriately.

If a client provides their own images, ideas, or sketches, they remain responsible for having the rights to use them. We may use project notes or images for record-keeping purposes where appropriate and lawful, but any use of client-related material will be handled respectfully and in line with agreed expectations.

18. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in services, legal requirements, or business practices. The version in effect at the time a booking is made will usually apply to that specific job, unless a newer version has been clearly agreed. Clients are encouraged to review the terms periodically.

Final Statement

These Terms and Conditions are intended to promote transparency, professionalism, and trust in every landscaping project. By setting clear expectations from the outset, we help ensure that work is completed efficiently and with mutual understanding. Whether the job involves routine garden care or a larger outdoor transformation, the same principles apply: clear communication, fair payment, safe working, and respect for the agreed scope.

Landscapers Bow values honest service, practical planning, and high standards of workmanship. If all parties understand their responsibilities, the process becomes smoother and the results are more likely to meet expectations. Good landscaping depends not only on skill, but also on clear terms that support a successful working relationship.
